The seal for the snake was given to him when he was born. It bound itself to his soul and will ultimately kill him. In CnJ, Tayuya found the spirit at the Valley of the End-or whatever it’s called- and it’s like an elemental spirit, formed by really bad things and such.
Why is its form is a serpent? Serpents are, as always, said to be evil and all that crap. That and it fits the attitude of the spirit.
